This Privacy Notice is issued in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the Privacy Notice Guidelines in force in the United Mexican States.

1. Identity and address of the data controller

Neucore, a neurosurgical practice led by Dr. Erick Estrella Ortiz, with its address for the purposes of this Notice at Suite 1028, Hospital Star Médica Querétaro, Boulevard Bernardo Quintana Arrioja 4060, San Pablo, C.P. 76125, Santiago de Querétaro, Querétaro, Mexico, is the party responsible for processing the personal data you provide, and will protect it in accordance with the applicable legislation.

2. Personal data we collect

For the purposes described in this Notice, we may collect the following categories of personal data:

  • Identification data: full name, age, date of birth, gender.
  • Contact data: telephone number, email address, home address.
  • Academic and professional data: occupation, when relevant to clinical care.
  • Billing data: RFC (tax ID), legal name, tax address, and banking details, solely when a tax receipt must be issued.

This data may be collected directly when you provide it in person, in writing, by telephone, through electronic means, or by any other technology, as well as when we obtain it through sources permitted by law.

In addition, this website uses cookies and web analytics tools (Google Analytics) that automatically and in aggregate collect browsing data —pages visited, time spent, and traffic source— in order to measure use of the site and the effectiveness of our outreach campaigns. This information is processed statistically and is not used to identify you personally. You may disable cookies through your browser settings at any time, without affecting the site’s essential functionality.

3. Sensitive personal data

Given the clinical nature of our practice, we will collect personal data considered sensitive under Article 3, section VI, of the LFPDPPP:

  • Present and past health status.
  • Clinical history and medical-surgical background.
  • Results of diagnostic studies (imaging, laboratory, electrophysiology) and clinical notes.
  • Medication, allergies, and known adverse reactions.
  • Family contact information for emergencies.

The processing of this sensitive data requires your express consent, in accordance with Article 9 of the LFPDPPP. By accepting this Notice, you grant such consent for the clinical purposes described below.

4. Purposes of processing

Primary purposes (necessary for the clinical relationship):

  • Respond to your request for a consultation or initial appointment.
  • Perform the clinical evaluation, establish the diagnosis, and propose the treatment plan.
  • Coordinate the scheduling and performance of surgical procedures when applicable.
  • Maintain the clinical record in accordance with NOM-004-SSA3-2012.
  • Provide postoperative follow-up and monitoring appointments.
  • Issue tax receipts and maintain accounting records.
  • Comply with legal, regulatory, and health obligations (COFEPRIS, health authorities).

Secondary purposes (not necessary for the clinical relationship):

  • Send informational communications about new services, clinical developments, or publications from the practice.
  • Conduct satisfaction surveys to improve the quality of care.

If you do not wish your data to be used for the secondary purposes, you may state so by sending an email to neucoremexico@gmail.com with the subject «No deseo finalidades secundarias». Declining the use for secondary purposes will not be grounds for refusing you the clinical services requested.

5. Transfers of data to third parties

To fulfill the primary purposes, your data may be transferred to the following third parties, who assume the same obligations of confidentiality and protection:

  • Host hospitals where the consultation or surgical procedures take place (Hospital Star Médica Querétaro, Hospital Santo Tomás, Hospital Ángeles Centro Sur, Hospitales MAC, Hospital San José, Hospital San José Moscati), for care coordination purposes.
  • Specialist physicians, anesthesiologists, and the surgical team involved in your care, when the case requires it.
  • Laboratories and imaging facilities that perform complementary studies.
  • Insurers and financing providers, solely when you expressly authorize it for reimbursement or coverage purposes.
  • Health, tax, or judicial authorities, when a duly founded legal requirement exists.

Except in the foregoing cases, we do not transfer your personal data to third parties without your prior consent.

6. ARCO rights and revocation of consent

You have the right to know what personal data we hold about you, what we use it for, and the terms of the use we give it (Access). You likewise have the right to request the correction of your personal information when it is outdated, inaccurate, or incomplete (Rectification); to have it removed from our records or databases when you consider that it is not being used in accordance with the principles, duties, and obligations set out in the regulations (Cancellation); as well as to object to the use of your personal data for specific purposes (Opposition).

To exercise any of the ARCO rights, you must submit the corresponding request to the email address neucoremexico@gmail.com, including the following information:

  • The data subject’s full name and a means to communicate the response to you.
  • A copy of a valid official identification document.
  • A clear and precise description of the data in respect of which you seek to exercise the right.
  • Any information that facilitates locating the data.

We will respond to your request within no more than twenty business days from its receipt, in accordance with Article 32 of the LFPDPPP.

You may also revoke at any time the consent you have granted us for the processing of your personal data, through the same procedure. The revocation will not have retroactive effects and will not apply in cases where it is necessary to continue processing in order to comply with obligations arising from the current clinical relationship or from legal and health obligations.

7. Limiting the use or disclosure of your data

To limit the use or disclosure of your personal data for secondary purposes, you may send the corresponding request to the email address neucoremexico@gmail.com.

8. Security measures

We have implemented reasonable administrative, technical, and physical security measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing, in accordance with Chapter III of the Regulations of the LFPDPPP. These measures include controlled access to the clinical record, the safekeeping of physical and digital files, and the confidentiality of the personnel involved in your care.

9. Changes to this Notice

We reserve the right to make modifications or updates to this Privacy Notice at any time in order to address legislative developments, internal policies, or new requirements for providing or offering our services. Any modifications will be made available on this same page and will take effect upon their publication.

10. Acceptance of the Notice

By providing your personal data through the contact form, by email, by telephone, or by any other means, as well as by receiving our clinical services, you express your awareness and acceptance of this Privacy Notice and grant your consent to the processing of your data on the terms described herein, including the processing of sensitive personal data for the primary purposes indicated.
